Welcome to Business Advertising Terms & Conditions

Please read these Terms & Conditions and if you’re happy please email your logo and a brief description of what your company does to the email shown at the top of every page marking the email with title as Advertising.
By sending an email requesting to advertise you are automatically indicating that your agree with these Terms & Conditions (hereinafter known as T&C’s).

Within these T&C’s the reference ‘we’ is attributed to the website owner which is Derby in Need CIC, trading as Enlivening, or one of divisions including but not restricted to The Bread Basket, The Food Bank Scheme, School’s Out Café, Christmas Project and Christmas Day Lunch.
By requesting to advertise on this website and, if accepted, you agree to place an advert on your website/social media group/ social media page for Enlivening, our logo and a link to the home page of this web site.
Failure to comply with No 2 will result in your advertising request being rejected.
All businesses wanting to advertise must either be a start-up or a fledgling business with an annual turnover of less than £100,000. Proof maybe required before we allow you to advertise.
Your business must be based in Derby or Derbyshire.
Your business should be registered with HMRC for either VAT or Corporation Tax purposes. We may ask you for proof. Exceptions may be made for small ‘craft or seasonal businesses’.
Your business must NOT be a franchise or a business operating under similar trading agreements i.e. Avon, Weight Watchers etc.
Your business will receive ONE year’s free advertising, after which time we may ask for payment for it to continue to advertise.
I f your company requests to continue advertising we will charge a fixed fee £100 per calendar year.
Your company will be advised 2 months before the end of your ‘free first year’ that your free advertising period will end on a specific date, via the email address provided.
Failure to respond to our email or failure to pay the fee will result in your advertising being removed from this website and we will expect our details to be removed from your website/social media group/page.
However, we will not employ or consider employing debt collectors to obtain the fee as it is your choice whether you continue to advertise with us or not.
We withhold the right and may on occasions ask for proof that your business is still operating
We reserve the right to ask that no significant complaints have been received about your company. (For reference, ‘significant’ means any complaint that has been taken to court or has proven detrimental to your business.
Failure to respond to any matters raised in Items 10, 11, 13 or 14, within 14 days will result in the immediate removal of your company’s advertising from this website.
Should we receive any complaints directly from your customers we will:
1. Initially contact you, via the email address provided, to ask you to deal with the issue in a satisfactory manner.
2. We will not get involved in any dispute between your company and any customer.
By choosing to advertise on this web site there will be no assumption to or fact that the website owner is a business partner with your company and any legal claims will be denied by the website owner.
Some businesses, which will be placed in the top places of the web page, will receive free advertising for as long as they qualify and agree with No’s 1, 2, 3, 4, 5, 6 and 7 (shown above). This is because these businesses contribute to and support Derby in Need CIC or one of our divisions.
However, if said advertisers breach any of the conditions contained in No’s 1, 2, 3, 4, 5, 6 and 7 (shown above) their free advertising will end immediately and they will be liable to pay the annual fee for future advertising (See No 6 above).
This website is owned and operated by Derby in Need CIC.
Derby in Need CIC is registered at Companies House, in England & Wales No 10653824 and the registered office is 28 Shalfleet Drive, Alvaston, Derby DE24 0US.
Derby in Need CIC reserve the right to change these T&C’s at any time and in such case all advertising businesses will be notified immediately of the changes by the email address provided.
